Defending Applications: Transactions at Undervalue & Preferences

Trustees in bankruptcy often seek to set aside transactions at undervalue under sections 339 and 340 of the Insolvency Act 1986. These claims can threaten your financial future and your reputation. We have a strong track record in defending undervalue transaction claims, where:

  • Assets were transferred for legitimate reasons
  • There was no intention to defraud
  • The value received was fair at the time
  • The transaction occurred outside the relevant time period

Similarly, we defend preference claims, where a creditor is alleged to have received more than others shortly before the bankruptcy. We can prove when no unfair preference occurred, or when the payment was part of normal commercial dealings.
