BANKRUPTCY CLAIMS

We Protect You from Bankruptcy Claims

Expert Defence for Bankruptcy Litigation

We represent individuals, directors, and third parties who find themselves defending:

Applications to set aside transactions at undervalue

Claims involving preferences given to certain creditors

Allegations of defrauding creditors or wrongful conduct

Trustee in bankruptcy recovery actions

Applications to annul bankruptcy orders

Whether you are being accused of transferring assets prior to bankruptcy or being unfairly pursued by a trustee, our team and close network of bankruptcy defence solicitors and barristers will rigorously defend your position.
Defending Applications

Defending Applications: Transactions at Undervalue & Preferences

Trustees in bankruptcy often seek to set aside transactions at undervalue under sections 339 and 340 of the Insolvency Act 1986. These claims can threaten your financial future and your reputation. We have a strong track record in defending undervalue transaction claims, where:

Assets were transferred for legitimate reasons

There was no intention to defraud

The value received was fair at the time

The transaction occurred outside the relevant time period

Similarly, we defend preference claims, where a creditor is alleged to have received more than others shortly before the bankruptcy. We can prove when no unfair preference occurred, or when the payment was part of normal commercial dealings.

Allegations of Defrauding Creditors?

If you are accused of defrauding creditors, hiding assets, or misusing your position as a director or individual, you need urgent legal representation. Allegations under Section 423 of the Insolvency Act 1986 are serious and may result in freezing orders or asset recovery proceedings.

Our team provides clear advice and a strong defence for complex cases involving:

Alleged fraudulent transfers

Asset shielding pre-bankruptcy

Connected party transactions

Director misconduct allegations
